Booking Fee

A non-refundable booking fee of £50 is required to confirm your booking.

Final Payment

The balance must be paid before digital images and/or prints are delivered to you.

Display

Pinner Portrait Photography may display any photographs taken by their photographers:

In their studio
On our web site
As part of our portfolio
Marketing literature
In display areas
At exhibitions
As part of a competition
In our advertising
In a public slide shows

Please let us know in advance if you do not want your images made public.

Images

All image sizes are nominal. The Photographers will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to record on film or digitally the exact colour as seen by the human eye.

Copyright

Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act for you to copy or allow to be copied photographically, electronically or by any other means an image created as part of a contract with Pinner Portrait Photography without the written permission of The Photographers.

Artistic Licence

The Photographers shall be granted artistic licence in relation to the poses photographed and the locations used. The Photographers judgement regarding the locations/poses and number of images taken shall be deemed correct.

Limitation of Liability

In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.

Cancellation

The Client may cancel this contract at any time by giving written/email notice to Pinner Portrait Photography but in doing so shall forfeit any monies paid.

Negatives/Digital Files

Negatives / digital files remain the property of Pinner Portrait Photography. Pinner Portrait Photography grant by means of these Terms & Conditions a licence for the Client to use the copies of the non-watermarked images provided for their personal use, including printing and posting on social media. The licence does not include the right to copy and/or distribute the digital images, or the right to distribute prints. The licence does not include the use of any of the images for commercial gain. Images may not be used for promotion or advertising unless agreed in advance (for example if that was the purpose of the shoot).

Note that the water-marked proof images are not covered by this licence and no rights are extended to the client for their use, with the exception of viewing and selecting images.

Prices

We are not registered for V.A.T.

Commercial Gain

Neither the client or the photographer may use the images for commercial gain without the agreement of the other party as documented in a formal contract. Use of images by the client without such a contract is contrary to the Copyright and Design Act 1988.

Complaints

Any complaints should first be raised by the Client with the Pinner Portrait Photography in writing within 21 days from the date of receipt of images. In the unlikely event of an unresolved complaint the Client may request the Society of Wedding and Portrait Photographers to mediate but only on the basis that its decision shall be final and binding upon both parties.
